| Issue 176: Lohmann, Ulrich: Informed Consent und Ersatzmöglichkeiten bei Einwilligungsunfähigkeit in Deutschland - Ein Überblick. 2. Auflage . August 2009 | | | Informed consent and feasible surrogates in the case of incapacity to agree in Germany – A general overview.
Information of the patient and his given consent are nowadays after longterm developments the legal and medico-ethical principal condition for any medical treatment. If the patient is not able to give his consent, a legal guardian, a former empowered attorney, written advance directives of the patient or his supposed will can substitute the consent. As these surrogates have different advantages and disadvantages, they have to be balanced. The paper discusses the long-standing ethical and legal discussions and describes the situation after the adoption of a law on patients' arrangement by the German Bundestag.
